PAYMENT POLICY:
The Client(s) shall pay 50% non-refundable down payment made at contract signing. This deposit shall be applied toward the Purchase Price of package purchased and identified herein above. The remaining balance of the Purchase Price due from the Client(s) to Urban Shindigs is due 2 weeks prior to your event date. Payments may be made by cash or credit/debit card.

CANCELLATION & REFUND POLICY:
The 50% down payment is non-refundable. Cancellation of this Contract by the Client(s) which is received in writing more than 180 days prior to the event will result in a refund of any monies paid, less than the 50% down payment. Cancellation of Services received less than 90 days prior to the event obligate the Client(s) to make full remaining payment of the total fees agreed upon. If cancellation is initiated by Urban Shindigs monies paid to Urban Shindigs from the Client(s) shall be fully refunded INCLUDING the 50% down payment.
OVERTIME: If and when agreeable to the Client(s) and Urban Shindigs, the
time of the DJ/MC Coordination may be extended at the pro-ratable overtime rate of $150.00 per hour, to be paid prior to the overtime period. Urban Shindigs agrees to play 6 hours max up to 10pm. Anything over 6 hours or past
10pm is an additional $150/hr.
CLIENT(S) RESPONSIBILITY:
The Client(s) are responsible for all decisions regarding their event and Event Date, including but limited to responsibility for selection of all vendors, third parties, individuals, entities, venues, participants, clothing, decorations, music, food, beverages, etc. and payment for the services or goods provided. Urban Shindigs is not responsible for the failure of any vendor, individual, entity or third party to deliver the quality or quantity of services or goods expected by or contracted for the Client(s) Urban Shindigs hereby expressly waives any warranty of fitness for a particular purpose or warranty of merchantability with regard to any service, good, individual, entity, vendor or third party recommended to or used by the Client(s) by Urban Shindigs during services rendered under this Agreement. The Client(s) agree that the Client(s) shall be responsible for executing all contracts with and making all deposits and timely payments to all individuals, entities, vendors, and third parties involved in providing goods or services for their event.
ADDITIONAL TERMS AND CONDITIONS: It is hereby further agreed; that the Client(s) shall be held liable for any injury or damages to the Urban Shindigs, or
property of Urban Shindigs, while on the premises of the event address. If damage is caused by the Client(s) or guest, members of Client(s) organization, engagement invitees, employees, or any other party in attendance, whether invited or not. It is understood that if this is a "Rain or Shine" event, Urban Shindigs
compensation is in no way affected by inclement weather. For outdoor performances, Client(s) shall provide overhead shelter for setup area. Urban Shindigs reserves the right, in good faith, to stop or cancel the performance should the weather pose a potential danger to staff, the equipment, or audience. Every effort will be made to continue the performance. However, safety is paramount in all decisions. Urban Shindigs compensation will not be
affected by such cancellation. In the event of circumstances deemed to present a threat or implied threat of injury or harm to Urban Shindigs staff or
any equipment in Urban Shindigs possession, Urban Shindigs reserves the right to cease performance. If the Client(s) are able to resolve the threatening situation in a reasonable amount of time (maximum of 30 minutes), Urban Shindigs shall resume performance in accordance with the original terms of this agreement. Client(s) shall be responsible for payment in full, regardless of whether the situation is resolved or whether Urban Shindigs resumes performance. In order to prevent equipment damage or liability arising from accidental injury to any individual attending this performance, Urban Shindigs reserves the right to deny any guest access to the sound system, music recordings, or other equipment.
DISPLAY RIGHTS:
Urban Shindigs reserves the right to use photos from your event for promotion, display, advertisement, Internet, publication, etc.
SEVERABILITY:
If any provision of this Contract will be held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable. If a court finds that any provision of this Contract is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision will be deemed to be written, construed, and enforced as so.
GOVERNING LAW:
This Contract shall be construed in accordance with the laws of the State of California.
LIMIT OF LIABILITY:
Client understands that Urban Shindigs reserves the right to medical privacy and does not agree to, or is held liable for any regulations or requests that invade medical privacy for example but not limited to vaccinations of any kind, proof of vaccinations, tests, temperature checks, medical devices or release of medical conditions to perform their services at the contracted event.
ENTIRE AGREEMENT:
This Agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.
The undersigned Client(s) have read, understood & agreed to the Urban Shindigs policies and terms listed in this contract.
